Background: In 2005 a new phenomenon was revealed in Israel of candidates for heart transplantation who were offered their transplant in China on a prescheduled date and eventually got it on that date. Together with the 2007 founded NGO Doctors Against Forced Organ Harvesting (DAFOH), evidences were then gathered which have clearly shown the gruesome systematic use and sale of organs of executed prisoners and prisoners of conscience for organ transplantation. Transplant tourism from Israel to China has flourished in the following three years due to persistently low organ donation rate in Israel. These lower donation rates were the result of cultural and religious objection towards recognition of brain death among parts of the society, combined with “free riding” behavior of these elements regarding accepting organs for transplants, as well as generous reimbursement of transplant tourism by insurance agencies regardless of the legality of the transplant operation performed abroad (mainly in China). A unique new Organ Transplantation Law, drafted to counter-balance these phenomena, and a law defining brain death determination, made a marked impact on the Israeli organ transplantation scene.

 

배경: 2005년 심장이식 대기 중이던 이스라엘 환자들이 중국에서 예정일을 포함한 이식 수술 제안을 받고 결국 그 날짜에 수술을 받은 새로운 사실이 밝혀졌다. 2007년 설립된 비정부기구인 DAFOH(강제장기적출에 반대하는 의사들 모임)와의 협력으로 사형수나 양심수들의 장기가 조직적으로(국가적으로) 사용되거나 판매가 되고 있다는 끔찍한 사실을 분명하게 보여주는 증거들을 모을 수 있었다. 이스라엘에서 중국으로의 원정장기이식 여행은 지속적인 이스라엘 국내의 낮은 기증률 때문에 2005년 이후 3년간 번창했다. 번창의 이유는 사회 전반의 뇌사 인정에 대한 문화적 종교적 반대 등으로 인해 장기 기증률이 아주 낮은 것, 자기는 기증하지 않으면서 기증 받으려 하는 “무임승차” 심리, 그리고 중국 본토에서 이뤄지는 이식수술의 적법성을 개의치 않는 보험회사의 관대한 보험금 상환이 합해진 결과이다. 독창적인 신 장기이식 법은 이런 현상들과 뇌사자 결정 기준의 균형을 잡아줌으로써, 이스라엘 장기이식의 분야에 현저한 영향을 주었다.

 

 

Methods: In March 2008 Israel's Parliament passed into legislation two laws relevant to organ transplantation:

(A) The Brain Death Law which defines the precise circumstances and mechanisms to determine brain death;

(B) The Organ Transplantation Law which includes several unique clauses:

(1) Total ban of reimbursing transplants performed abroad if they are performed under the definitions of organ trade or against local laws;

(2) Granting prioritization in organ allocation to candidates for organ transplantation who have either been registered as organ donors for at least 3 years prior to being listed as candidates or have been live kidney or liver-lobe donors or have given their consent for actual organ donation of their deceased next-of-kin;

(3) Removing disincentives for living donation by providing modest insurance reimbursement and some social supportive services.

Following an extensive multi-media campaign, the impact of the gradual implementation of these new laws has finally been witnessed in the 2011 annual results of Israel’s National Transplant Center.

 

방법 : 2008년 3월, 이스라엘 국회는 장기이식 관련 법 2가지를 제정했다.

(A) 뇌사를 판단할 정확한 정황과 기제를 정의하는 뇌사 법

(B) 독창적인 몇몇의 조항을 포함한 장기 이식 법 :

(1) 보험금 지급 금지: 해외 장기이식수술에 대한 보험금 지급의 전면적 금지 (그것이 장기 매매 하에서 이루어지거나 그 지역 법을 어기는 것일 경우)

(2) 우선적 장기 할당 : 장기수여대기명단에 이름을 올리기 최소 3년 전에 장기를 기증하겠다고 등록한 적이 있거나 신장, 간엽을 기증한 적이 있는 경우, 혹은 사망한 직계가족의 장기를 기증한다고 실제적인 동의서를 제출한 장기이식후보자들에 한해 장기 할당의 우선권 수여

(3) 살아있는 장기기증자에 대한 일정 정도의 보험 급여와 사회지원서비스 제공을 통한 보상을 통해 (장기 기증의) 장애요인 제거

후속적인 광범위한 방송매체 캠페인, 이 새로운 법들의 점진적 이행의 효과는 결국 2011년 이스라엘 국립 장기이식 센터의 연간 결과에서 증명되었다.

 

 

Results: In 2011 there were 89 deceased organ donors compared to 60 in 2010, which represents a significant increase in organ donation rate from 7.8 donors per million population to 11.4. In 2011 267 organ transplantations from deceased donors were performed compared to 157 in 2010. Consent rate for organ donation from deceased donors has risen from 49% in 2010 to 55% in 2011. The monthly number of new registered donors has risen from a mean number of 2889 in the years 1998 - 2010 to a monthly mean of 6273 in 2011, representing an increase in registered donors from 10% to 12% of the adult population.

Kidney transplantations from living donors have markedly risen from 71 in 2010 to 117 in 2011. The annual number of patients who underwent kidney transplantation abroad has sharply dropped since 2008 from 155 in 2006 to an all-time low of 35 in 2011.

Transplant tourism from Israel to China came to a complete halt. In parallel, in 2012 DAFOH ran a petition, which generated 250,000 signatures in U.S., Europe and Australia, to ask the United Nations Human Rights Council to investigate on unethical organ harvesting in China. DAFOH directors testified before U.S. Congress and at a hearing in the European Parliament.

 

결과 : 사후 장기 기증자 수는 2010년 60명에서 2011년 89명으로 증가했다. 이로 인해 인구 백만 명당 장기기증자수가 7.8명에서 11.4명으로 상당히 증가했다. 사후 기증자로부터의 이식 수술 건수는 2010년 157건에서 2011년 267건이 되었다. 사후 장기기증 동의율은 2010년 49%에서 2011년 55%으로 상승했다. 장기기증 등록수는 매달 늘어나 1998년에서 2010년 사이 평균 2,889건이던 것이 2011년 월 평균 6,273건에 이르렀는데, 이는 장기 기증 등록률이 성인인구의 10%에서 12%로 증가했음을 나타낸다.

생존 장기기증자들에 의한 신장 장기이식수술 건수는 현저하게 증가해서 2010년 71건에 비해 2011년 117건에 이르렀다. 2008년 이후 연간 해외에서 신장이식 수술을 받는 환자의 수가 급격하게 감소하였는데, 2006년 155건에서 2011년 사상최저치인 35건으로 줄었다. 이스라엘에서의 중국 원정 장기이식 여행은 완전히 중단되었다.

2012년 국회에서 DAFOH는 청원서 운동으로 25만명의 서명을 미국, 유럽과 호주에서 받아 유엔인권위원회(the United Nations Human Rights Council)에 중국의 비윤리적인 장기적출을 조사할 것을 청원했다. DAFOH의 이사들은 미국 국회에서 그리고 유럽국회 공청회에서 증언했다.

 

 

Conclusions: The implementation of the new Israeli Organ Transplantation Law, along with the Brain Death Law, has resulted in a significant increase in organ transplantations both from deceased donors, by prioritizing holders of donor cards, and from living donors, by removing disincentives for living donation. In addition transplant tourism from Israel to China was brought to a complete halt by banning its reimbursement.

 

결론 : 뇌사 법과 병행하여 이스라엘의 신 장기이식법의 발효는 장기기증 카드 소유자에게 장기이식 우선권을 부여하고, 생존자의 장기기증으로 인한 불이익을 제거해 줌으로써 사후 장기기증과 생존 장기기증 양쪽 모두에 의한 이식수술을 현저히 증가시켰다. 게다가 이스라엘에서의 중국원정장기이식 여행은 보험금 지급을 금지함으로써 완전히 중단되었다.

In 2005 I was approached one day by a patient of mine with an unusual message. This patient has been continuously hospitalized in my department for more than one year with severe heart failure and has been a top priority candidate on the Israeli waiting list for heart transplantation. He reported to me he was fed up with the endless wait for a suitable heart donor and was told by his medical insurance company…

 

2. 2005년 어느 날 내 환자 한명이 심상치 않은 메세지를 가지고 나를 찾아왔습니다. 그는 심장 관련 문제로 일 년 이상 우리 병원에 입원해 있었고 우리나라의 심장이식수술 대기명단 1순위에 올라 있었습니다. 자신에게 맞는 심장 기증자를 찾는데 지쳐있던 그에게 의료 보험 회사로부터 연락이 왔는데….

 

 

3. …to come to China in two weeks’ time as he was scheduled to undergo heart transplantation on a specific date. When I have asked him how come such an operation can be scheduled ahead of time, he responded he did not bother to inquire. The patient had indeed gone to China and underwent the operation on the exact date as promised ahead of time.

 

3. …심장 이식 수술 일이 잡혔으니 2주 이내에 중국에 들어오라는 것이었습니다. 수술날짜를 미리 잡을 수 있다는 것이 이상하여 그에게 물어보니 일부러 문의해 보지는 않았다고 했습니다. 그 환자는 정말로 중국으로 건너가 미리 예정되어 있던 그날 수술을 받았습니다.

 

 

4. In order to understand the background to this story, you have to be aware of the grim status of organ donation in Israel at that time. As can be seen in these graph the number of candidates waiting each year for the various organs (in orange) much exceeds the number of transplants performed (in green).

5. Shown otherwise, the organ donation rate per million population in Israel has always been one of the lowest amongst most other Western countries.

6. The causes of the low organ donation rate have always been multi-factorial. One of the major causes has always been religious and cultural objection towards determination of brain death and organ donation.

7. In order to overcome this barrier, in 2008 the Israeli Parliament has passed into legislation the Brain and Respiratory Death Law which defines the precise circumstances and mechanisms to determine brain death.

8. The law mandates the compulsory performance of apnea test and ancillary brain imaging testing in addition to the clinical bed-side criteria;

9. It defines qualifications of physicians to be certified as members of brain death committees;

12. Another major cause of the low organ donation rate has been generous reimbursement of transplant tourism by Israeli insurance agencies and sick funds which have fully covered most of the high expenses transplants were available anywhere around the globe, regardless of their legality.

 

12. 장기 기능이 부진한 또 하나의 주요 원인은 이스라엘 보험회사와 질병펀드(sick fund)가 이식 관광 보험금 지급에 관대하기 때문입니다. 그들은 시술이 세계 어느 곳에서 이루어졌든 간에 합법성 여부와도 상관 없이, 이식과 관련한 고비용을 전부 부담해 주었습니다.

 

 

13. So, back to our story, up to 2008 China has been one of the major venues for Israeli patients to get kidney transplants. For years I have heard these stories from my colleagues but never really bothered to inquire, as it was my assumption that the source of these kidneys were poor Chinese people selling one of their kidneys in order to improve their economic status. This was the first time I have been made aware of the possibility to undergo heart transplantation in China, as no Israeli patient has ever gone there for this operation before, and the fact that you can get it on a specific pre-scheduled date was a total surprise to me and got me researching.

 

13. 다시 위에서 했던 이야기로 돌아가겠습니다. 2008년까지 중국은 이스라엘 환자들의 신장이식 시술 주요 국가였습니다. 이러한 사실에 대해 동료들로부터 들어 이미 알고 있었지만, 가난한 중국인들이 경제적 상황을 개선하기 위해 자신들의 신장중의 하나를 떼어 판 것이라는 가정하에 별 심각성을 느끼지 못하고 있었습니다. 그러나 내 환자의 이야기를 들은 후 이스라엘 환자들이 한번도 중국에 가서 심장 이식 수술을 받은 적이 없어서 몰랐지만, 이제 중국에서도 심장이식 수술을 할 수 있다는 것을 알았습니다. 그런데, 환자가 미리 예정한 날짜에 심장을 구해 시술 받는다는 것은 제게는 너무도 놀라운 일이었습니다. 저는 조사해 보지 않을 수 없었습니다.

 

 

14. It did not take me long to find out the gruesome details of the abhorrent Chinese practice since the 1980s, whereby the source of most of the transplanted organs are prisoners sentenced to death or prisoners of conscience, whose consent is either non-existent or ethically invalid and whose demise might be timed for the convenience of the waiting recipient, and their sell to anyone who can afford the cost. When I have started my research in 2005 this practice was still officially denied by the Chinese authorities and therefore the sources of information were mainly the testimony of Dr. Wang Guoqi, a former doctor in the Police Tianjin General Brigade Hospital, who fled to the US and spoke in a hearing before the subcommittee on International Operations and Human Rights of the committee on International Relations of the House of Representatives on June 2001.

 

14. 1980년대 이후 중국의 끔찍한 관행에 대해 자세한 내용을 알아내는데 그리 오랜 시간이 걸리지 않았습니다. 대부분의 이식된 장기들은 사형수나 양심수들의 것이었는데 그들의 동의 서류는 아예 없거나 윤리적 타당성이 없는 것이었고 그들이 처형되는 시간은 장기 이식을 원하는 수령자의 편의에 따라 조정되었습니다. 2005년 이러한 조사결과를 발표했을 당시 중국 정부는 이러한 사실에 대해 공식적으로 부인하고 있었기 때문에 조사 대부분의 정보는 미국으로 망명한 톈진 무장 경찰 병원 의사 왕궈치 씨의 증언에 따른 것이었습니다. 그는 2001년 6월 하원 외교위원회 내 국제활동(international operation) 및 인권 소위원회 공청회에서 이러한 사실을 폭로했습니다.

 

 

15. As I was about to publish my research findings, Dr. Jiefu Huang, Vice Minister of Health of the People’s Republic of China, has publicly admitted for the first time on December 2005 that apart from a small portion of traffic victims most of the cadaveric organs in China come from executed prisoners, albeit claiming that the only prisoners who are subject to capital punishment in the PRC are convicted criminals and that prisoners or their family provide informed consent for donation of organs after execution.

 

15. 조사 결과를 공개적으로 발표하려던 즈음 중국 위생부 부부장 황지에푸는 2005년 12월 소수의 교통사고 희생자 외에 대부분의 장기는 이미 처형된 죄수들의 시체들에서 나온 것이며 사형선고를 받은 죄수들은 유죄인 범죄자들로서 죄수들 본인 혹은 그 가족들은 사형 집행 후 장기기증에 대해 사전 동의했다고 주장했습니다.

 

 

16. The results of my research were first published in October 2006 in the Journal of the Israeli Medical Association and I have added a call for the cessation of the Israeli participation in the process as I have found out that, of all transplant tourists gathering to China from all over the world to get organs, the Israeli patients were probably the only ones fully reimbursed by their insurance companies. I have referred to this reimbursement as providing a de-facto recognition of the Chinese transplant activities as being legal and ethical and have called upon Israeli authorities to immediately ban it all together and denounce any Israeli participation in the atrocious process.

On July 2006, when my paper has already been sent for publication, and after several more Israeli patients went to China and got heart transplantations, David Matas and David Kilgour have published their first version of The Bloody Harvest report in which they have revealed for the first time the chilling information regarding the use of executed Falun Gong practitioners as a major source of organs in China.

25. Following the intensive public discussion, a special meeting of the Health Committee of the Israeli Parliament has unanimously expressed its revulsion of the abhorrent practice in China and issued a call to stop sending Israeli patients for organ transplantation to China. The committee went further and together with the ministry of Health made sure that the new Organ Transplant Law, accepted by our Parliament on March 2008, will ban and bring a halt to organ trade and transplant tourism.

29. The Israeli law defines and outlaws organ trade by stating that:

(a) A person should not receive any compensation in exchange for an organ which has been procured or is planned to be procured from his or another person's body, whether the organ has been procured during the person's life or after his death.

32. Chapter 36 of the law states that 

(a) A person who will perform any of the above will be sentenced to three years in jail and will be fined according to the Penalty Law, clause 61(a)(4)(d); and that (b) The orders of clauses (a)(1 – 3) above will apply whether the organ procurement or transplant will be performed within or outside Israel.

(1) The procurement of the organ and its transplantation have been performed according to the law in the country under discussion;

(2) The orders against organ trade, as stipulated in this Law, are kept.

34. Shortly afterwards rules have been issued ordering all Israeli insurance companies to stop reimbursing any organ transplants performed in countries in which illegal organ procurement or organ trade have been known to take place.

The second cause for the low organ donation rate is the so-called “free-riding” behavior of those who reject brain death and thus organ donation yet do not abstain from being active candidates for organ transplantation themselves. This phenomenon arouses significant antagonism towards organ donation and has been repeatedly cited in public opinion surveys as one of the major reasons for the low consent rate for organ donation.

In order to overcome this hurdle I have proposed to the National Transplant Center to implement a unique organ allocation plan whereby candidates for organ transplantation who have been registered as organ donors for at least 3 years prior of being listed will be prioritized during organs allocation.

The recommendations of this committee were incorporated into the Organ Transplant Law which states that candidates for transplantation will be prioritized during organs allocation as follows:

Top priority will be granted to candidates whose first degree relative donated organs after death or have been themselves live kidney or liver-lobe donors;

72. In 2012 DAFOH ran a petition to ask the United Nations Human Rights Council to investigate on the unethical, systematic and state sanctioned, forced organ harvesting from detained prisoners of conscience (Tibetan, Uighurs, House Christians and Falun Gong practitioners) in China.

The petition generated 250,000 signatures in U.S., Europe and Australia.

As an interesting side story, following the signatures of several Israeli Parliament members on this petition, the Chinese embassy in Israel has issued a formal complaint to the Israeli Foreign Ministry and demanded clarifications, stating that they were unpleasantly surprised by the member of Parliament’s signatures on the petition. Unfortunately, few of those Members of Parliament who have originally signed the petition have retracted their signatures following this complaint.
